Terms and Conditions of Use of the beem App
Scope of application
These Terms and Conditions of Use shall apply in the relationship between you and Swisscom (Switzerland) Ltd, Alte Tiefenaustrasse 6, Worblaufen, Switzerland, company number CHE-101.654.423 (hereinafter referred to as “Swisscom”), to your use of the Swisscom beem App (hereinafter referred to as the “App”).
By using the App, you confirm that you are aware of the rights and obligations established under these Terms and Conditions of Use, that you agree to them and that you will comply with all obligations.
Functionality of the App
The App forms part of the Swisscom beem Service (hereinafter referred to as “Swisscom beem”), a holistic network and security solution. By actively using the App on your internet-enabled device, hereinafter referred to as the “Device”, Swisscom beem allows Swisscom business customers, by means of various security measures, to protect internet traffic on your Device as well as access to servers and data of Swisscom business customers against a variety of cyber risks. This is conditional on the requirement that a business customer of Swisscom (“Swisscom Business Partner”, e.g. your employer) has authorised you to use the App and has obtained a valid user licence for you from Swisscom.
When the App is actively used, internet traffic with all network connections on your Device is encrypted and routed through a secure tunnel to Swisscom's central protection infrastructure. As part of this process, the original IP address of your internet Device is also concealed from third parties.
Depending on the version of Swisscom beem selected by the Swisscom Business Partner, it may activate further protective functions, such as having your SSL/TLS-encrypted and/or unencrypted internet and email traffic (incoming and outgoing) automatically scanned for malicious content, activating filter functions, applying policies for blocking certain protocols, advertising, trackers and third-party applications on your Device, detecting and blocking phishing as well as fraudulent websites.
In addition, the Swisscom Business Partner may make access by you to its company's servers and data conditional upon the use of the App, restrict or prohibit your access based on the information obtained using the App, including location data, at the time of your attempt to access them and restrict or prevent the outflow of data. The Swisscom Business Partner may also specify further security-related functions and policies, in particular via the device management functions. In addition, it may view aggregated information relating to data traffic on all devices protected by Swisscom for it with Swisscom beem (e.g. data volume and top-ten operators for all connections protected by it using Swisscom beem).
You can also access the Swisscom beem Security Centre via the App. In the Swisscom beem Security Centre you can display the inventory of your Devices with a valid beem service license (such as iPhone or Android tablets). In addition, you can integrate Devices into the service and remove them from it, delete content remotely from your own Devices and request security reports. Swisscom may periodically inform you via an existing communication channel regarding updates to the security reports.
Usage
Your consents
By using the App, you acknowledge and agree to the following:
In order to secure the internet traffic operated through your Device, telecommunications traffic is analysed for potential security risks and functions are implemented to protect against malware and/or malicious content.
If the Swisscom Business Partner activates corresponding functionalities via Swisscom beem, your SSL/TLS-encrypted telecommunications traffic will also be automatically decrypted, analysed for malicious content, and blocked or otherwise encrypted in the event of any potential security risks.
These enable the Device condition to be analysed and compared with the applicable security policies of the business customer.
Geolocation information (via wifi, mobile network or IP address) is analysed via the App, particularly with reference to usage restrictions (e.g. to prevent access from abroad).
A Swisscom Business Partner that has authorised you to use the App is able to influence the software on your Device (e.g. force or install certain apps or prevent them from running or installing) and specify security settings.
Preconditions for use
In order to use the App, a business customer of Swisscom must have purchased a valid user licence for you, thereby enabling you to use the App.
The App for Android devices is available in the Google Play Store. The App for iOS/iPadOS devices is available in the Apple App Store. The App for Windows or macOS devices is available on the Swisscom website. Alternatively, the Swisscom Business Partner may install the App via device management.
When installing the App, you will need to authenticate yourself – depending on the particular Swisscom beem configuration – using a Swiss mobile phone number and a one-time password or via your Swisscom business account.
Your version of the operating system must be compatible with the App. The supported versions of the respective operating system are displayed in the app stores.
In order to enable scanning for malicious content, you must install a security certificate on your Device in accordance with Swisscom's installation instructions. The App assists you throughout the process of installing the certificate.
Right of use
You shall receive a personal, non-exclusive, non-transferable right restricted to the duration of the provision of services by Swisscom to use the App on your Devices in accordance with the offer in the app stores. The App can be downloaded from app stores in Switzerland and, to a limited extent, in other countries.
The scope of the functions available to you and the duration of use shall be governed by the Swisscom beem Agreement under which access to the App was activated for you by a Swisscom Business Customer.
Duties of care
You must always use the latest App provided by Swisscom.
You are responsible for the protection of your device code, especially for choosing a secure code, as well as for protecting your Device against third-party access. The device code must be kept secret and must not be disclosed to any other person.
To ensure protection against misuse of the App, no overused or common combinations (e.g. "123456") or otherwise easily identifiable combinations, such as telephone number, date of birth or vehicle number plate, may be chosen when selecting the device code.
If you know or have reason to suspect that a third party knows your device code, you must immediately change your device code in the device settings.
Device software must be kept up to date. In particular, updates (updates, upgrades, service packs, hotfixes, etc.) made available by the manufacturer must be installed. The Device must be used appropriately and in accordance with the manufacturer's contractual terms. Specifically, you shall bear all risks exacerbated or occasioned by any alteration or replacement of the device software installed by the device manufacturer (e.g. through a "jailbreak/rooting" or other software that violates the terms and conditions of use specified by the manufacturer). You agree to install software (particularly other apps) on your Device exclusively from trustworthy sources.
Availability
Swisscom shall endeavour to provide the App without interruption, although does not warrant that it will be able to do so. Swisscom may limit the availability temporarily if this is necessary, for example, with regard to capacity limits, or the safety or integrity of the servers, or to perform technical maintenance or repairs and this is for the purpose of providing the services properly or improving them. Swisscom shall however endeavour to take into account the interests of the users of Swisscom beem.
Handling of your data
Swisscom collects, stores and processes only data that are needed to provide Swisscom beem. You can find out how Swisscom processes your data in the Privacy Policy at Privacy Statement.
Costs
Use of the App is free of charge for you. A data transfer charge may be imposed by your mobile service provider.
Amendments
Swisscom may alter the App and amend these Terms and Conditions of Use at any time (e.g. add, discontinue or alter functions) or discontinue the App altogether. Swisscom beem business customers shall be notified concerning any amendments to the Terms and Conditions of Use and their effective date, as well as concerning any discontinuation of the App. You may refuse to accept the new terms and conditions by refraining from any usage of the App after the effective date. If you continue to use the App after the effective date, you shall be deemed to have accepted the amended Terms and Conditions.
Relationship to your app store
You acknowledge that your app store is under no obligation to provide maintenance and support services regarding the App.
If a third party claims that the App or your possession thereof infringes its intellectual property rights, Swisscom, and not your app store, is responsible for defending against these claims.
You hereby authorise your app store to enforce these Terms and Conditions of Use if only the App itself is affected, and, if necessary, to enforce them independently against you.
Export
This App is subject to the export control regulations and other laws of the USA and may not be exported, re-exported, or transferred to certain countries (currently Russia, Ukraine, Cuba, Iran, North Korea, Sudan and Syria) or to persons or legal entities who are prohibited from receiving export goods from the USA (including those listed (a) in the Denied Persons List or Denied Entity List of the Bureau of Industry and Security and (b) in the List of Specially Designated Nationals and Blocked Persons of the Office of Foreign Assets Control).
Liability and force majeure
In the event of a breach of contract, Swisscom shall be liable for proven damages unless it can demonstrate that it is not at fault. No liability shall arise for damages resulting from minor negligence, unless required otherwise by law. Under no circumstances shall Swisscom incur liability for losses resulting from any unlawful or non-contractual use of the App.
Swisscom shall not be liable to you if due to force majeure the performance of the service is temporarily interrupted, restricted in whole or in part, or rendered impossible. The term “force majeure” includes in particular natural phenomena of particular intensity (avalanches, flooding, landslides, etc.), acts of war, riots, unforeseeable official restrictions and pandemics or epidemics. If Swisscom cannot fulfil its contractual obligations, the performance of the Agreement or the deadline for performing the same shall be postponed according to the force majeure event that has occurred.
Term and termination
The contractual relationship governed by these Terms and Conditions of Use shall be of indefinite duration. Swisscom is entitled to terminate the contractual relationship at any time without indicating any reason. Upon termination of the Swisscom beem Business Customer Agreement, the contractual relationship governed by these Terms and Conditions shall end automatically without any requirement for notice by Swisscom.
You may stop using the App at any time and delete it from your Device.
Jurisdiction, applicable law
All legal relationships concerning these Terms and Conditions of Use shall be subject to Swiss law, excluding the conflict-of-laws rules of private international law.
In the event of any dispute, we shall endeavour to resolve it amicably. Subject to any mandatory jurisdictions - in particular for consumers pursuant to Art. 32 and 35 Civil Procedure Code - the place of jurisdiction shall be Bern, Switzerland.
